Terms & Conditions

These terms and conditions ("Terms") apply to the CoHunt mobile application (hereby referred to as "Application") created by Diamondback Consulting LLC (hereby referred to as "Service Provider," "we," "us," or "our") as a subscription-based service.

1. Acceptance of Terms

By downloading, installing, or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Application.

2. Description of Service

CoHunt is a mobile application that provides:

Map-based navigation and location tracking for outdoor activities
Trail recording and management features
Peer-to-peer communication and activity sharing through Berty technology
Weather information and outdoor activity planning tools
Group coordination features for hunting and outdoor activities

3. User Accounts and Subscriptions

You must create an account to use the Application
You are responsible for maintaining the confidentiality of your account credentials
You are responsible for all activities that occur under your account
You must provide accurate and complete information when creating an account
The Application operates on a subscription basis with pricing clearly displayed in the app
Subscription fees are billed in advance on a recurring basis
You may cancel your subscription at any time through your app store account settings

4. Acceptable Use

You agree to use the Application only for lawful purposes and in accordance with these Terms. You agree NOT to:

Use the Application in violation of any laws or regulations
Use the Application while operating a vehicle or in any unsafe manner
Transmit any unlawful, threatening, abusive, or otherwise objectionable content
Attempt to gain unauthorized access to any portion of the Application
Interfere with or disrupt the Application or servers
Reverse engineer, decompile, or disassemble the Application
Remove, alter, or obscure any proprietary notices
Use the Application for commercial purposes without our written consent

5. Hunting and Outdoor Activity Safety

The Application is a tool to assist with outdoor activities but does not replace proper safety practices
You are solely responsible for complying with all hunting laws and regulations in your jurisdiction
You acknowledge that outdoor activities carry inherent risks
The Service Provider is not responsible for any accidents, injuries, or legal violations
Always verify local hunting seasons, licensing requirements, and property boundaries
GPS and mapping features may not be 100% accurate and should not be your only navigation method

6. Peer-to-Peer Features and User Content

The Application enables direct peer-to-peer communication between users
You are solely responsible for content you share with other users
The Service Provider does not monitor or control peer-to-peer communications
You grant other users in your shared activities permission to view your shared location and activity data
You may revoke sharing permissions at any time by leaving the shared activity
The Service Provider has no liability for content shared between users

7. Intellectual Property Rights

The Application and its original content, features, and functionality are owned by the Service Provider
The Application is protected by copyright, trademark, and other intellectual property laws
You are granted a limited, non-exclusive, non-transferable license to use the Application
All feedback, suggestions, or ideas you provide may be used by us without compensation

8. Privacy and Data Collection

Our data collection practices are described in our Privacy Policy
We collect only minimal data necessary for account management and service improvement
Peer-to-peer communications are not accessible to or stored by the Service Provider
Location data is used only for app functionality and is not stored on our servers

10. Disclaimers and Limitations of Liability

THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We do not warrant that the Application will be error-free or uninterrupted
We are not liable for any indirect, incidental, special, or consequential damages
Our total liability shall not exceed the amount you paid for the Application in the past 12 months
We are not responsible for GPS inaccuracies, map errors, or connectivity issues
We are not liable for any hunting accidents, legal violations, or property disputes

You agree to indemnify and hold harmless the Service Provider from any claims, damages, losses, or expenses arising from:

Your use of the Application
Your violation of these Terms
Your violation of any laws or regulations
Content you share through the Application
Your outdoor activities

12. Device Requirements and User Responsibilities

You are responsible for maintaining compatible devices and internet connectivity
You are responsible for any data charges from your mobile carrier
You should not jailbreak or root your device as this may compromise security
You are responsible for keeping your device secure and maintaining battery life
The Application requires certain permissions (location, camera, etc.) to function properly

13. Updates and Modifications

We may update the Application periodically
Some updates may be required for continued use
We may modify features or discontinue the Application with reasonable notice
We reserve the right to suspend or terminate accounts that violate these Terms

14. Termination

You may terminate your account at any time
We may terminate or suspend your account for violations of these Terms
Upon termination, your right to use the Application ceases immediately
Provisions that by their nature should survive termination shall remain in effect

15. Governing Law and Disputes

These Terms are governed by the laws of the United States and the State of Idaho

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms constitute the entire agreement between you and the Service Provider regarding the Application and supersede all prior agreements.

18. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through:

Email to your registered address
Updating the "Last Updated" date

Continued use after changes constitutes acceptance of the modified Terms.

19. Age Restrictions

You must be at least 13 years old to use the Application. By using the Application, you represent that you meet this age requirement.

20. Export Control

You may not use or export the Application in violation of U.S. export laws and regulations.
